Terms and Conditions for Contest Entries
2013 Foodie of the Year Entries
Entries to the Foodie of the Year Contest are subject to the terms and conditions below. The winner cannot exchange the prize for cash. The airfare is for the winner only and to a destination serviced by a major airline such as Air Canada, Westjet or Porter. If the final destination is at a remote location not serviced by a major airline, the winner will have to cover the cost of that connecting flight only. The luxury hotel stay will not include incidental room charges or gratuities; hotel breakfasts will only be included if it is part of the standard room rate. The dinner for two will be for a cash value to be determined based on the restaurant chosen by the winner. The winner agrees to have their name used for promotional purposes by Vacay.ca and also to document his/her experience for use in an article in this publication. The contest prize does not include rental of any vehicle or transportation costs while at the destination of choice.

Contests upon receipt and will not be returned. Promotion Parties and our Sponsors assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of contests; (d) inaccessibility or unavailability of the Internet or any combination thereof, or; (e) any injury or damage to participant’s or to any other person’s computer which may be related to or resulting from any attempt to participate in the contest entry or download any materials in the contract. Any attempt to deliberately alter or damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Vacay.ca
and or the sponsors and promotion parties, reserve the right to seek remedies and damages to the fullest extent permitted by law – including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entries that are unintelligible will be disqualified. Sponsor assumes no responsibility for human or technical error in the transmission or receipt of entries. The winners release Vacay.ca
, its affiliates, their directors, employees, officers and agents, including without limitation their advertising and promotion agencies, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, including any travel related thereto.
Limitations of Liability
If, for any reason, the contests are not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this and future contests, then Sponsor reserve the right at its sole discretion to cancel, terminate, modify or suspend the contests and giveaways in whole or in part. In the event an insufficient number of eligible submissions are received or Sponsor is prevented from awarding prize or continuing with the contest or give-aways as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend, or terminate the contests and giveaways. If the contest or giveaways is terminated for Force Majeure before the designated end date, Sponsor will (if possible) select the winner from all eligible, non-suspect submissions received as of the date of the event giving rise to the termination.
The contests is open to all legal residents of Canada (excluding Quebec) who have reached the age of 19 years. Contests and giveaways excludes employees (and persons with whom they are domiciled) of the Sponsor, their advertising and promotional agencies and its Members and Partners. This contests is subject to all applicable Federal, Provincial, Municipal and State laws and regulations. All decisions of the independent contests judging organization are final and the contest and giveaways Sponsor shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the contests. The Sponsor reserves the right to modify, amend or terminate the contests and giveaways with no obligation or liability if due to fraud, virus, bugs or other causes beyond the control of Sponsor or the administration, security or proper play of the game, subject to applicable law. The Sponsor reserves the right to modify, amend or terminate this contests with no obligation or liability, subject to applicable law.
